Documents that worker remains in valid status under a pending application. Useful for employer payroll continuity + traffic stops.

R183 of IRPR (maintained status, formerly "implied status") allows a worker / student / visitor to remain in Canada on the same conditions as their prior permit while their extension application is being processed — PROVIDED the application was filed BEFORE the original permit expired. For workers, this means: • Continue working for the SAME employer • In the SAME occupation • At the SAME location • Cannot change employer / occupation / start a new role under implied status Draft a 250-350 word implied status maintenance letter for [CLIENT_NAME] that the worker can present to their HR department, payroll provider, or CBSA officer (e.g. if pulled over while driving). §1 — IDENTITY + STATUS (50-70 words) "This letter confirms that I, [CLIENT_NAME] (passport number [PASSPORT], UCI [UCI]), am maintaining lawful temporary resident status in Canada pursuant to s.183(5) of IRPR. My current [EXPIRED_PERMIT_TYPE] expired on [EXPIRED_PERMIT_EXPIRY]. I submitted an extension application on [EXTENSION_APPLIED_DATE], confirmed by IRCC receipt [RECEIPT_NUMBER]." §2 — STATUTORY ANCHOR (60-80 words) "Section 183(5) of IRPR provides: 'A foreign national continues to have temporary resident status... during an extension period if they applied for the extension before their period of authorised stay ended... and the application has not been decided.' I confirm: (a) I applied for an extension before my permit expiry (b) IRCC has acknowledged receipt (c) No decision has yet been issued (d) I have remained in Canada continuously" §3 — CONTINUED COMPLIANCE (60-80 words) "During the maintained status period: • I continue to work only for [EMPLOYER_NAME] (Annex A — employer letter confirming continued employment) • I continue in the same occupation: [POSITION_TITLE] (NOC [CODE]) • I continue at the same location: [WORK_LOCATION] • I have not begun any new employment, study, or business pending decision • I will leave Canada if the extension is refused, unless I exercise restoration or other rights" §4 — PRACTICAL IMPACT FOR THIRD PARTIES (40-60 words) For employer payroll: continue T4 / EI / CPP withholdings as before. For CRA / SIN registration: no change. For provincial health: continue current registration. For driving licence: continue current licence until permit re-issuance triggers renewal. §5 — CONTACT (30-40 words) "For verification, IRCC may be contacted referencing application receipt [RECEIPT_NUMBER]. My current employer can be contacted at [HR_EMAIL] / [HR_PHONE]. I am available at [EMAIL] / [PHONE]." DOCUMENTS THE WORKER SHOULD CARRY: □ This letter (printed, signed) □ Most recent expired work permit (paper copy) □ IRCC application receipt acknowledgement □ Letter from current employer confirming continued employment □ Passport □ Recent pay stub (proof of continued legal work) End with: "DRAFT IMPLIED STATUS LETTER — for RCIC review. Note: maintained status under R183 does NOT cover travel outside Canada. If [CLIENT_NAME] leaves Canada during processing, they may not be able to re-enter as a worker until new permit issued."
