Irish naturalisation after 5 years reckonable residence. Form 8, good character, declaration of fidelity, dual citizenship preserved.
IrelandNaturalisationINCA 19565-year reckonableForm 8
Build an Irish naturalisation strategy for [CLIENT_NAME] (first arrival [FIRST_ARRIVAL_DATE]; current [CURRENT_STAMP]; reckonable residence [RECKONABLE_RESIDENCE_YEARS] years; children born in Ireland: No).
§1 — LEGAL BASIS (90-110 words)
Irish Nationality and Citizenship Act 1956 (INCA) as amended (1986, 2001, 2004, 2024). Section 15 grants Minister for Justice discretion to grant naturalisation if statutory conditions met:
(a) Of full age
(b) Of good character
(c) Lawful residence in the State for 1 year continuous immediately before application
(d) Lawful residence totalling 4 of the 8 years preceding the 1-year continuous period (so 5 of 9 reckonable years)
(e) Intention in good faith to continue residing in Ireland after naturalisation
(f) Made a declaration of fidelity to the State + loyalty to the State
(g) Other conditions Minister may prescribe
Reform 2024: streamlined process + faster decision-making targeted (verify Heads of Bill / Act).
§2 — RECKONABLE RESIDENCE CALCULATION (110-140 words)
NOT all time in Ireland is reckonable:
• Stamp 1 (Employment Permit) — RECKONABLE
• Stamp 1G (Spouse of CSEP / Post-Study Graduate) — RECKONABLE
• Stamp 4 LTR — RECKONABLE
• Stamp 5 Without Condition — RECKONABLE
• Stamp 2 (Student) — NOT RECKONABLE (post-2011 students)
• Stamp 0 (Limited residence) — NOT RECKONABLE
• Stamp 3 (Dependent without work rights) — Partially reckonable for spouse of Irish citizen/EEA worker; not for general dependent
For [CLIENT_NAME] [RECKONABLE_RESIDENCE_YEARS]: subtract any Stamp 2 / Stamp 0 periods. Mahmood v Minister for Justice [2018] IEHC 218 + subsequent jurisprudence clarify edge cases (extended absences, leave abroad).
Continuous residence in final year: physical presence with allowed absences (typically <6 weeks total).
§3 — APPLICATION DOCUMENTS — FORM 8 (110-140 words)
Application via Form 8 (Application for Certificate of Naturalisation) at ISD:
• Completed Form 8 with signatures (notarised)
• Application fee: EUR 175 (adult) [VERIFY current]
• Certification fee: EUR 950 on grant of naturalisation
• Total: EUR 1,125
• Documents:
- Passport + IRP card history (all stamps)
- Birth certificate
- Marriage certificate (if applicable)
- 6 colour photos
- Garda clearance / character (last 3 years residences)
- Revenue tax compliance certificate (P60s, Statements of Earnings)
- Bank statements (3 months minimum)
- Address history with utility bills proving each address
- Employment evidence (current + history)
- Witnessing affidavits / declarations (statutory declarations of identity)
§4 — GOOD CHARACTER TEST (70-90 words)
Minister assesses "good character" broadly. Negative factors:
• Criminal convictions (any, including minor — declared on Form 8)
• Garda investigations (even without conviction)
• Civil money judgements
• Tax evasion / Revenue disputes
• Immigration breaches (overstays, working in breach of conditions)
• Misrepresentations on prior applications
Positive factors:
• Long employment + tax history
• Community engagement
• Voluntary work / civic participation
For Indian-cohort: disclose all incidents fully; concealment is more damaging than minor incidents.
§5 — DUAL CITIZENSHIP — INDIA INTERACTION (90-110 words)
Ireland recognises + permits dual citizenship:
• Irish naturalisation does NOT require renunciation of prior citizenship from Ireland's side
• [CLIENT_NAME] retains Indian citizenship by Irish law
However: INDIA does NOT permit dual citizenship under Indian Citizenship Act §9. On acquiring Irish citizenship, [CLIENT_NAME] loses Indian citizenship by operation of Indian law (automatic). Practical consequence:
• Renounce Indian citizenship at Indian mission post-Irish naturalisation
• Obtain Surrender Certificate
• Apply for OCI (Overseas Citizen of India) card
• OCI provides lifetime visa-free access to India + most resident rights (no voting, no agricultural land, no public office)
§6 — CITIZENSHIP CEREMONY + NEXT STEPS (40-60 words)
On approval:
• Pay certification fee EUR 950
• Attend citizenship ceremony (Killarney or Dublin)
• Take Declaration of Fidelity + Loyalty
• Receive Certificate of Naturalisation
• Apply Irish passport (~EUR 75)
• Register Indian renunciation at Indian mission
• Apply OCI card
Processing total: 12-24 months from Form 8 lodgement to ceremony.
End with: "DRAFT NATURALISATION STRATEGY — for review by Irish solicitor specialising in citizenship. Reckonable residence calculation is the most common dispute; track Stamp history precisely + apply only after meeting full 5-of-9-years + 1-continuous requirement. Indian renunciation post-grant is administrative but must be done — keep OCI application ready."Purchase the vault to unlock
