Build a B-1/B-2 214(b) refusal recovery plan for [CLIENT_NAME] (prior 214(b): [PRIOR_REFUSAL_DATE] at [PRIOR_CONSULATE]; total visitor refusals: [NUMBER_OF_REFUSALS]). §1 — 214(b) LEGAL POSTURE (90-110 words) INA §214(b) is procedural — not a finding of fraud. No formal appeal (Saavedra Bruno v. Albright, 197 F.3d 1153, D.C. Cir. 1999 — consular nonreviewability). Re-application is the only remedy. 9 FAM 403.10-3(B): subsequent officers will see prior refusal in the CCD (Consular Consolidated Database); they will weight new evidence against prior fact pattern. No "cooling off" period — same-day re-application is technically permitted but rarely productive without new material facts. §2 — WHAT CHANGES MATTER FOR VISITORS (130-160 words) For B-1/B-2, the question is not "skills" but "ties + purpose + funds." Material-change levers in order of impact: 1. Stronger ties — got married, had a child, started a business, bought property, took family ITR up significantly 2. Clearer purpose — specific event with documented invitation (wedding, conference with paid registration, funeral, medical appointment letter) 3. Better travel history — successfully completed visits to Schengen, UK, Canada, Australia, Japan, Singapore with on-time returns 4. Funds maturity — savings have been stable + grown over 6-12 months post-refusal 5. Career progression — promotion, salary increase, role change consistent with established employment Refusal at age 22 → re-apply at age 27 with marriage + child + 5 years stable employment is a different applicant. §3 — RE-APPLICATION DS-160 DISCIPLINE (100-130 words) • New DS-160 mandatory • Disclose prior refusal honestly — answer "Have you ever been refused a US visa?" YES; specify date + place + visa type • Concealment = INA §212(a)(6)(C)(i) misrepresentation, lifetime bar • Update employment section with current role + tenure • Update social media handles • Update travel history with new entries • Update funding source with current bank account • US contact: same [US_CONTACT] or new? Disclose all • Photo less than 6 months old [WHAT_CHANGED]: weave as factual updates not justification. §4 — INTERVIEW DAY (110-140 words) Officer's first question: "I see you were refused before. What's different now?" 30-second answer: • One sentence factual prior — "I applied in [year] and was refused under 214(b)." • Two specifics on change — "Since then, I've gotten married, my wife and I have a 2-year-old son in India, and I've been promoted to [role] at [employer]." • One sentence current purpose — "I'd like to visit my brother for his wedding in Atlanta in June." Avoid: • Arguing prior refusal • Asking the officer why you were refused (officer will not explain) • Showing emotional escalation Carry the updated evidence file but offer only when asked. §5 — WHEN TO STOP (60-80 words) Three B refusals on the same fact pattern → strong likelihood of pattern record. The fourth attempt without dramatic change (e.g. multi-year successful international travel, major life events, very strong invitation letter for documented event) is generally counterproductive. Consider Canada visit visa as a smoother alternative for family visit purposes. UK / Schengen visa approvals can serve as objective demonstration of "credible visitor" identity for a future US re-application. §6 — ALTERNATIVE: ESTA / VWP — INELIGIBLE FOR INDIANS (40-60 words) India is not on the Visa Waiver Program list. Indian passport holders cannot use ESTA. Some Indian-origin OCI holders + Canadian / UK passport holders may use VWP if eligible by other nationality — verify dual citizenship and use the strongest passport. Pure Indian passport holders must use B visa. End with: "DRAFT 214(b) RECOVERY PLAN — for U.S. immigration counsel review if multiple prior refusals. Single 214(b) refusals usually resolve with documented material change; multi-refusal patterns benefit from a multi-month strategic delay."
