EU Blue Card (AufenthG §18g) — strategy for Indian skilled worker
Blue Card eligibility, salary threshold, BA consent (or exemption), 33→21 month accelerated PR path.
GermanyBlue CardAufenthG §18gEU Directive 2021/1883
Variables · 65 required
Build an EU Blue Card strategy for [CLIENT_NAME] hired by [EMPLOYER_NAME] for [POSITION_TITLE] at EUR [ANNUAL_GROSS_SALARY_EUR] gross/year. Qualification: [DEGREE]. Shortage occupation: N.
§1 — LEGAL BASIS + 2023 REFORM (90-120 words)
EU Blue Card transposed into German law via Aufenthaltsgesetz §18g (renumbered + revised in November 2023 reform package implementing EU Directive 2021/1883). Replaces the prior §19a regime. Key changes:
• Lowered salary threshold (especially for shortage occupations + recent graduates)
• Expanded shortage-occupation list to include IT specialists without formal degree (if 3+ years comparable professional experience)
• Family reunification fast-tracked
• PR fast-track preserved: settlement permit (Niederlassungserlaubnis) after 27 months (21 months with B1 German)
• Mobility rights to other EU Blue Card states after 12 months in Germany
§2 — ELIGIBILITY CRITERIA (110-140 words)
[CLIENT_NAME] must satisfy:
(a) University degree recognized in Germany (anabin H+ status OR APS certificate, Indian cohort) — [DEGREE] verification step
(b) Concrete job offer from [EMPLOYER_NAME] (signed work contract, NOT job offer letter alone)
(c) Job offer matches qualification field (e.g. IT degree → IT role; engineering → engineering role)
(d) Salary thresholds (2024 figures — verify current):
• Regular occupations: ≥ EUR 45,300/year gross
• Shortage occupations (Engpassberufe — IT, STEM, medicine, math, science, education): ≥ EUR 41,041.80/year gross
• Recent graduates (within 3 years of degree): ≥ EUR 41,041.80/year gross
For [ANNUAL_GROSS_SALARY_EUR]: compare against applicable threshold. If N = Y → lower threshold applies.
§3 — BUNDESAGENTUR FÜR ARBEIT (BA) CONSENT (90-120 words)
Under BeschV §2, Bundesagentur für Arbeit (Federal Employment Agency) must consent (Zustimmung) to most foreign worker employment. EXEMPTIONS where consent NOT required:
• Blue Card holders earning ≥ EUR 45,300 (regular threshold) — automatic exemption under BeschV §2(2)
• Workers with German university degree (regardless of where they studied if anabin-recognized) — under shortage scenarios
• IT specialists with 3+ years experience meeting reduced salary threshold (under 2023 reform)
For salary in shortage band (EUR 41,041 — 45,300): BA consent required, BA conducts:
• Vorrangprüfung waived for Blue Card (no priority check against German/EU workers)
• Working conditions check (wage parity with German workers, working hours, contract terms)
• Decision within 2-3 weeks typically
§4 — RECOGNITION OF INDIAN DEGREE (90-120 words)
For Indian-cohort:
• Check anabin (Zentralstelle für ausländisches Bildungswesen) database for [INSTITUTION_NAME] status
• If anabin H+ → degree directly recognized for Blue Card
• If H- or unlisted → ZAB (Zentralstelle für ausländisches Bildungswesen) Statement of Comparability needed
• APS certificate (mandatory for Indian applicants since Nov 2022) generally satisfies academic verification for visa, but for Blue Card a ZAB Statement of Comparability is often required separately
• Regulated professions (medicine, law, teaching, engineering for certain Länder) need additional state authority recognition (Anerkennung)
• Reform 2023 — engineering bachelor's degree from anabin-recognized institution qualifies even without formal Anerkennung in many Länder
§5 — APPLICATION PROCESS (90-120 words)
(a) Apply for visa at German mission in India ([CONSULATE]: New Delhi / Mumbai / Chennai / Bengaluru / Kolkata)
(b) Documents: VIDEX form, passport, biometric photo, employment contract, degree + APS + ZAB if needed, CV, motivation letter (optional but helpful)
(c) Fee: EUR 75 [VERIFY]
(d) Processing: 2-12 weeks (faster under accelerated skilled-worker procedure — beschleunigtes Fachkräfteverfahren under AufenthG §81a)
(e) Issued: D-visa valid 6 months for entry
(f) Post-arrival: Anmeldung within 14 days at Einwohnermeldeamt + Aufenthaltstitel application at Ausländerbehörde
(g) Blue Card issued valid 4 years (or duration of contract + 3 months, whichever shorter)
§6 — PR FAST-TRACK PATHWAY (40-60 words)
After Blue Card:
• 33 months → eligible for Niederlassungserlaubnis (settlement permit) with A1 German
• 21 months → eligible with B1 German
• Pension contributions throughout count toward §9a fast-track
• Citizenship 3-year fast-track now possible under 2024 citizenship reform if integration thresholds met
